Terms of Service
These terms apply to your use of ListenDaily — the website at listendaily.app and any related services (together, "the Service").
By using the Service, you agree to these terms. If you don't agree, don't use the Service.
1. Who we are
You can reach us at [email protected] for any matter — support, billing, privacy, or legal notices.
2. Your account
You can use ListenDaily without an account on the free daily tier — anonymously, with no card required. If you create an account, you're responsible for:
- Keeping your sign-in details private
- The accuracy of the information you provide
- All activity that happens under your account
Tell us right away if you think someone else has accessed your account. You must be at least 16 years old to use the Service.
3. What the Service is, and what you can do with it
ListenDaily is a listening-practice tool for people who can read English but want to understand it spoken. You listen to short audio lessons in English, type what you hear, and track your accuracy over time. It is a personal-practice tool, not a substitute for a teacher, a tutor, or a certification programme.
You can listen to our lessons, type your answers, track your progress, and use the Service for personal language practice.
You may not:
- Copy, redistribute, or resell our lessons, audio, or course content
- Scrape, mirror, or systematically download the Service
- Reverse-engineer or attempt to extract our source code
- Use the Service to break any law, harass anyone, or violate anyone's rights
- Misuse the rate limits or attempt to disrupt the Service for other users
- Pretend to be someone else or create multiple accounts to evade restrictions
- Submit fraudulent payment details, use stolen cards, or abuse the chargeback process to dispute charges for services you have already used
- Use the Service to launder money, evade taxes, or finance illegal activity
4. Subscriptions and payment
Every user gets 10 minutes of practice per day, free forever, without a card. The daily allowance resets at midnight in your local timezone. To remove the daily cap, you can subscribe at USD 9 per month or USD 69 per year (saves about USD 39 vs. paying monthly), or pay USD 129 one-time for lifetime access. All paid options unlock unlimited daily practice and any new lessons we release.
Once you subscribe, your subscription renews automatically at the end of each billing period (monthly or annual, depending on the plan you choose) using the payment method on file. By subscribing, you authorize us and our payment provider to charge that payment method on each renewal date until you cancel.
You can cancel at any time from your account settings. Cancellation stops the next renewal — your access continues until the end of the period you've already paid for. We generally don't refund unused time; see the Refund Policy for exceptions.
Prices and the contents of each plan may change. For existing subscribers, we'll give you at least 30 days' notice before any price increase, and you can cancel before the new price applies. If you're on an annual plan, the price you signed up at applies for the rest of the term you've already paid for — a price change only takes effect at the next renewal.
Payments are processed by a third-party payment provider. We don't store your full card details. If you ever subscribe to the Service through a different platform we partner with, that platform's terms may also apply to billing, renewal, and refunds.
5. Refunds
See our Refund Policy. In short: cancel anytime to prevent the next renewal. We generally don't refund for time already used, with exceptions noted in that document.
6. Free tier
The 10-minute daily tier is genuinely free. We don't charge you, and we don't ask for a card to use it. Your daily allowance resets at midnight in your local timezone. Nothing auto-charges — we only ever bill you if you actively choose to subscribe or buy lifetime access. We may change the size of the free tier, but we won't retroactively bill you for time you used while it was free.
7. Content and copyright
The lessons, audio, text, design, software, and curriculum on the Service are owned by us or our licensors. They are protected by copyright and other laws.
You keep ownership of what you type into the Service. By submitting it, you grant us a limited license to store and process it so the Service can function.
8. Service changes and availability
We work hard to keep the Service running, but we don't guarantee it will be uninterrupted, error-free, or available at all times. If a change materially reduces what you've paid for, we'll let you know and offer a refund for the unused portion.
9. Termination
You can stop using the Service or close your account at any time. We can suspend or close an account if you break these terms or where we're required to by law. We'll try to notify you when this happens unless doing so would create a security or legal risk.
10. Disclaimers
The Service is provided "as is" and "as available." We don't warrant that it will help you reach any particular level of English. ListenDaily is a language-practice tool, not a substitute for professional language instruction or certification testing.
To the fullest extent permitted by law, we disclaim all warranties not expressly stated here, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions don't allow these exclusions; in that case, the exclusions apply only to the extent the law allows.
11. Limitation of liability
To the maximum extent allowed by law:
- We're not liable for indirect, incidental, or consequential damages
- Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose, or USD 100, whichever is greater
Nothing in this section limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or anything else that can't be excluded or limited under applicable law — including consumer-protection rights you have under the laws of your country.
12. Governing law and disputes
We try to resolve every dispute informally first — email [email protected] and we'll work it out. Nothing in these terms removes the right of consumers to bring a claim under the mandatory laws of the country where they live.
13. Changes to these terms
If we make material changes, we'll notify you by email or in the Service at least 14 days before they take effect. Continuing to use the Service after a change means you agree to the new terms.
14. Other terms
- Entire agreement — These terms (together with the Privacy Policy and Refund Policy) are the whole agreement between you and us about the Service.
- Severability — If any part of these terms is found unenforceable, the rest still applies.
- No waiver — Not enforcing a right doesn't mean we've waived it.
- Assignment — You can't transfer your account or these terms to someone else without our agreement. We can transfer these terms if our business is sold or restructured — your rights won't be reduced.
- Force majeure — Neither side is liable for failures caused by events outside reasonable control (for example, internet outages, infrastructure failures, or natural disasters).
